The Superintendent of Public Instruction must cooperate with the department upon request for evaluation. The Superintendent of Public Instruction may be asked to evaluate the education program provided at residential boarding schools in ordr to determine if the program meets the minimum standards required of public educational institutions.

Oregon state private residential schools require licensing by the Department of Human services. Standards for licensing include the physical health, care and safety of the children. The superintendent of public instruction advises on the educational program which is instructed by the residential school. If the facilities and operation of a private Oregon residential school meets the standards of the department for the physical health, care and safety of the children, the department will issue a license to operate the school. The license for operation will be valid for two years unless revoked. Amendments may be required at any time by the department in order to accommodate changes in factors upon which the issuance of a license for operation was based. Any person may file a complaint with the department alleging that children attending a private residential boarding school are not receiving shelter, food, guidance, training or education necessary to the health, safety, welfare, or social growth of the children. The department will then immediately investigate any complaints made.
